Terms of Service

These Terms of Service (“Terms”) govern your access to and use of userkits.streamcraftr.com and its related services (collectively, the “Site”), operated by Kevin Huer under the Stream Craftr name (“Stream Craftr,” “we,” “us,” or “our”).

By accessing or using the Site, creating an account, submitting content, or downloading a kit, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility and Authority
You must be legally capable of entering into a binding agreement to use the Site. If you have not reached the age of majority where you live, you may use the Site only with the permission and supervision of a parent or legal guardian who agrees to these Terms.

If you use the Site for an organization or another person, you represent that you have authority to accept these Terms on their behalf.

2. Accounts

An account is required to submit kits or post comments. An account is not required merely to browse or download publicly available kits.
When creating or using an account, you agree to provide accurate, current, and complete information; keep your login credentials confidential; not share, sell, or transfer your account; promptly update information that is no longer accurate; and notify us at support@streamcraftr.com if you suspect unauthorized account access.

You are responsible for activity occurring through your account to the extent permitted by law. We may require email verification before allowing submissions or other account features. Email verification confirms control of an email address at the time of verification. It does not verify a person’s identity, trustworthiness, ownership of submitted content, or legal authority.

We may suspend or terminate accounts that violate these Terms, threaten the security of the Site, repeatedly infringe the rights of others, or otherwise create legal or operational risk.

3. User Submissions and Uploader Responsibilities

Registered users may submit OBS kit packages, descriptions, images, comments, and related materials (collectively, “User Content”). You retain ownership of your User Content, subject to the licence granted in these Terms.

Each time you submit or update User Content, you represent and warrant that you own the content or have all permissions, licences, releases, and authority required to submit it and allow Stream Craftr to host and distribute it.

You represent and warrant that your User Content does not infringe or violate any copyright, trademark, patent, trade-secret, moral, privacy, publicity, personality, contractual, or other right. You must comply with the licence conditions for every third-party asset included in a kit, including images, fonts, audio, video, code, plugins, logos, and other materials.

Your User Content must not contain personal information unless you have a lawful basis and all necessary consent to include and distribute that information. Its title, description, attribution, licence information, and other statements must be accurate and not misleading.

Your submission must not contain malware, credential-harvesting functionality, destructive functionality, hidden cryptocurrency mining, undisclosed tracking, or code intended to bypass security controls. It must comply with these Terms and all applicable laws.
You must provide reasonable evidence of your ownership, rights, licences, or permissions if we request it. You are responsible for maintaining your own backup copies. The Site is not a backup or archival service.

4. Licence to Stream Craftr

By submitting User Content, you grant Stream Craftr a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, scan, analyze, cache, transmit, distribute, display, publicly perform, and make technical adaptations to that User Content as reasonably necessary to operate, secure, maintain, promote, and improve the Site and make your submission available to users.

This licence includes permission to create previews and thumbnails, change packaging or formatting for technical purposes, create backup copies, and allow our hosting, storage, content-delivery, security, and other service providers to perform these activities on our behalf. This licence does not transfer ownership of your User Content to Stream Craftr.

To the extent permitted by law, you consent to technical modifications and agree not to assert moral rights solely against modifications reasonably necessary to provide the Site.

If you request removal of your User Content, we may stop making it publicly available. Residual copies may temporarily remain in backups, security records, legal records, and systems operated by our service providers. Removal does not revoke rights already granted to people who downloaded the content and cannot recall copies that have already been downloaded.

5. Submission Review and Publication

New kits are held from public distribution pending review. Any change to a published kit, including replacement of its downloadable package, must undergo a new review before the updated version becomes publicly available.

Review may include manual inspection and available technical checks of file types, filenames, archive structure, metadata, scripts, and other indicators of possible policy violations or harmful content.

Certain archive structures, paths, encrypted files, executable files, native code, scripting files, server-side files, or other prohibited content may be rejected automatically. Web assets such as HTML, JavaScript, CSS, and SVG may be permitted where appropriate for a Stream Craftr kit and may receive additional review attention.

We do not promise that antivirus scanning, malware analysis, intellectual-property verification, security testing, or any other specialized screening will be performed on every submission. Review is limited and may not identify every malicious, vulnerable, unlawful, misleading, or unauthorized component.
Publication following review is not a certification, endorsement, approval, or guarantee that a kit is safe, lawful, accurate, original, compatible, or fit for any purpose.

We may quarantine, reject, require changes to, disable, or remove a submission at any time, including after publication. We are not required to provide advance notice before acting where immediate action is reasonably necessary to protect users, third parties, or the Site.

6. Prohibited Content and Conduct

You may not use the Site to submit content that violates another person’s rights or any applicable law.

You may not distribute malware, malicious or destructive code, credential-theft functionality, unauthorized-access tools, hidden cryptocurrency miners, or undisclosed tracking.

You may not attempt to evade review or security controls by disguising file types, using misleading extensions, encrypting or nesting archives to conceal content, creating decompression bombs, using path-traversal filenames, or otherwise concealing prohibited material.

You may not resubmit content that was previously rejected or removed without authorization or without correcting the reason for its rejection.

You may not post defamatory, fraudulent, unlawfully threatening, harassing, exploitative, obscene, or seriously hateful material.

You may not submit content that exploits minors, depicts the sexual abuse of minors, or endangers a child.

You may not impersonate another person, misrepresent your identity or affiliation, or publish private or identifying information without authorization.

You may not use the Site to spam, advertise, or solicit users without our written permission. You may not attempt to gain unauthorized access to the Site, its infrastructure, or another user’s account.

You may not interfere with the Site, circumvent technical limits, probe for vulnerabilities without permission, or place an unreasonable load on the Site.

You may not use automated bots, crawlers, scrapers, or bulk-download tools without our prior written consent, except for ordinary search-engine indexing.

7. Downloads and Assumption of Risk

Kits are created and submitted by third parties. Although submissions are reviewed before publication, Stream Craftr does not independently verify every included asset, licence, instruction, script, network request, security property, or compatibility claim.
You download, import, install, configure, and use kits entirely at your own risk. Before using a kit, you should inspect its contents, maintain current backups, use appropriate security software, and test it in a safe environment.

Stream Craftr is not responsible for changes a kit makes to OBS, your streaming setup, files, accounts, devices, networks, or third-party services.
Download protections, archive checks, manual review, and other security measures reduce certain risks but cannot guarantee that every harmful or unwanted component will be detected.

8. Moderation, Removal, and Account Enforcement
We may refuse, quarantine, restrict, unpublish, remove, or preserve User Content. We may limit Site functionality or suspend or terminate accounts when we reasonably believe doing so is appropriate for security, legal compliance, policy enforcement, protection of users or third parties, or operation of the Site.
We may act without advance notice where reasonably necessary. A decision to publish, reject, disable, or remove content does not constitute a legal determination about ownership, infringement, safety, or wrongdoing.

We are not obligated to host any particular submission or provide unlimited storage, bandwidth, downloads, or availability.
We may retain account identifiers, submission-time contact information, package hashes, technical metadata, review records, scan results, complaint records, and related communications as reasonably necessary to investigate abuse, enforce these Terms, resolve disputes, comply with legal obligations, and protect the Site and its users. Such information will be handled subject to our Privacy Policy and applicable law.

9. Copyright and Other Rights Complaints

If you believe content on the Site infringes your copyright or another legal right, email support@streamcraftr.com.

Your complaint should include your full name and contact information; identification of the protected work or right; the exact URL or location of the material at issue; a description of the alleged infringement or violation; the relevant date and time, if applicable; a statement that the information supplied is accurate and that you are the rights holder or are authorized to act for the rights holder; and your physical or electronic signature.

We may forward a complaint and the complainant’s contact information to the affected uploader. We may preserve related records, request additional information, temporarily disable content, or take other steps we consider appropriate.
Where applicable law requires us to process or forward a compliant notice and retain identifying records, we will do so.

Uploaders may respond with evidence of ownership, authorization, permission, licensing, or other relevant information. We may terminate accounts that repeatedly or seriously infringe the rights of others.

Knowingly submitting a false or misleading complaint may result in rejection of the complaint, account restrictions, or other remedies available under applicable law.

10. Indemnification

To the fullest extent permitted by law, if you submit User Content or use the Site on behalf of a business or organization, you agree to defend, indemnify, and hold harmless Kevin Huer, Stream Craftr, and their service providers from claims, liabilities, damages, judgments, settlements, penalties, losses, and reasonable legal expenses arising from or relating to your User Content, your breach of these Terms, your misuse of the Site, or your violation of another person’s rights.

We may control the defence of a covered claim, and you agree to provide reasonable cooperation with that defence. You may not settle a claim in a manner that imposes liability or obligations on Stream Craftr without our written consent.

11. Stream Craftr Intellectual Property

The Site’s design, branding, logos, software, documentation, and original content, excluding User Content and third-party material, are owned by or licensed to Stream Craftr.

These Terms do not transfer ownership of that material to you. You may not copy, modify, distribute, sell, license, or otherwise exploit it except as permitted by applicable law or with our prior written permission.

The Stream Craftr name and logo may not be used in a way that suggests endorsement, sponsorship, or affiliation without our permission.

12. Third-Party Services and Advertising

The Site may use or link to third-party hosting, content-delivery, identity, analytics, advertising, and other services. Third-party services are governed by their own terms and privacy practices. Stream Craftr does not control their content, security, policies, or availability.

The Site may display advertisements, including advertisements served by Google AdSense. Advertisements may be selected or personalized as described in our Privacy Policy and the advertising provider’s policies.
Stream Craftr does not endorse or assume responsibility for third-party advertisements, products, websites, content, or services. Your interactions with advertisers or third-party services are between you and the applicable third party.

13. Privacy

Our collection, use, retention, and disclosure of personal information are described in our Privacy Policy. By using the Site, you acknowledge that policy.

Do not submit personal information belonging to another person unless you are legally authorized to do so.
Information associated with submissions may include your WordPress user ID, submission-time email address, email-verification status where available, timestamps, technical metadata, package hashes, review information, and records required for security, complaint handling, or legal compliance.

14. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and all kits, User Content, and related services are provided “as is” and “as available,” without warranties or conditions of any kind, whether express, implied, statutory, or collateral.

Stream Craftr disclaims implied warranties and conditions of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, availability, security, and freedom from harmful components.

We do not warrant that the Site will be uninterrupted or error-free; that defects or harmful components will be detected or corrected; or that any kit will work with your equipment, software, OBS version, plugins, accounts, services, or configuration.
Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law.

15. Limitation of Liability

To the fullest extent permitted by law, Kevin Huer and Stream Craftr will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the Site, a kit, User Content, or these Terms.

This exclusion includes loss of profits, revenue, goodwill, opportunities, data, files, accounts, or use; business interruption; device or software damage; account compromise; service disruption; and the cost of substitute services, even if we were advised that such harm was possible.

To the fullest extent permitted by law, the total aggregate liability of Kevin Huer and Stream Craftr for all claims arising from or relating to the Site, kits, User Content, or these Terms will not exceed the greater of the amount you paid directly to Stream Craftr for use of the Site during the twelve months preceding the event giving rise to the claim or one hundred Canadian dollars (CAD $100).

These limitations do not exclude or restrict liability that cannot legally be excluded or limited. Your jurisdiction may provide rights that cannot be waived by contract.

16. Changes to the Site or These Terms

We may modify, suspend, restrict, or discontinue all or part of the Site. We may impose reasonable storage, bandwidth, file-size, submission, account, or download limits.
We may update these Terms from time to time. We will post the revised Terms and update the effective date. Where required by law, or where a change materially affects your rights, we will provide additional notice.

Changes apply prospectively from their stated effective date. Continuing to use the Site after that date constitutes acceptance of the revised Terms to the extent permitted by law.

We may require you to affirmatively accept revised Terms before submitting or updating additional User Content.

17. Termination

You may stop using the Site at any time. You may request account closure by contacting us, subject to information that we must or may lawfully retain.

We may suspend or terminate your access if you violate these Terms, create legal or security risk, repeatedly infringe the rights of others, threaten the operation of the Site, or where continued service is no longer commercially or technically practical.

Provisions that should reasonably continue after termination will survive. These include provisions concerning retained copies, intellectual-property ownership, licences, indemnification, disclaimers, liability limitations, disputes, and record retention.

18. Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules.

Subject to any non-waivable rights you may have, the courts of Ontario will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Site.

Before starting a formal proceeding, you and Stream Craftr agree to make a reasonable, good-faith attempt to resolve the dispute through written communication. Nothing in this section prevents either party from seeking urgent injunctive or protective relief where appropriate.

19. General Terms

These Terms and the policies expressly incorporated into them constitute the entire agreement between you and Stream Craftr concerning the Site.

If any provision is found to be invalid or unenforceable, that provision will be limited or removed only to the minimum extent necessary. The remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver of that provision or our right to enforce it later.

You may not assign or transfer these Terms without our written consent. We may assign these Terms as part of a reorganization, sale, transfer of the Site, or transfer to an affiliated operator, subject to applicable law.
Section headings are included for convenience and do not affect interpretation. Words such as “including” mean “including without limitation.” Electronic notices and agreements satisfy requirements that communications be in writing to the extent permitted by law.
